3. Adopt a Resolution Authorizing the City Manager to execute a Contractual Services Agreement with Browning-Ferris Industries of California, Inc. to procure SB 1383-compliant compost in an amount not to exceed $134,000 and to amend the 2026-2028 Biennial Budget.

4. Adopt a resolution establishing the Fiscal Year 2026-27 Tax Appropriations Limit

5. Adopt a Resolution approving a budget amendment to the 2026-2031 Capital Improvement Plan and an agreement with Urban Planning Partners, Inc. to provide professional planning services in the not-to-exceed contract amount of $459,776

6. Adopt a resolution authorizing the City Manager to execute Task Order No.34 to the Joint Powers Agreement with the City of Fremont for paratransit services with Ride On Tri-City! in an amount not to exceed $189,642 and amend the Biennial Budget

E. PUBLIC HEARINGS

1Hearing to consider property owners' objections and adopt a resolution confirming the Superintendent of Streets' Report concerning weed abatement assessments.

2. Hearing to consider adoption of a resolution approving amendments to the Master Fee Schedule for Fiscal Year 2026-27

3. Hearing to consider a Call for Review of the Planning Commission’s approval of a Conditional Use Permit (U2026-002) for a temporary commercial entertainment, Fear Overload Haunted House, at NewPark Mall located at 2086 Newpark Mall, Suite #1149 (APN 901-111-25) and consider adopting a resolution affirming the Planning Commission's action with changes or, in the alternative, consider adopting a resolution overturning the Planning Commission's action.

1. Adopt a Resolution Of The City Council Of The City Of Newark Calling An Election To Be Held On November 3, 2026, For Voter Consideration Of A Ballot Measure Seeking Voter Authorization To Repeal And Replace Chapter 5.04 Of The Newark Municipal Code To Amend The Current Business License Ordinance; Establishing Policies And Procedures In Connection With Such An Election; Requesting The Board Of Supervisors Of The County Of Alameda To Consolidate The Election With The General Election To Be Held On November 3, 2026; Requesting Certain Services Of The Registrar Of Voters Of Alameda County With Respect To The Consolidated General Municipal Election; And Providing For Submittal Of Ballot Arguments And Rebuttals And Authorizing The Filing Of An Impartial Analysis

2. Adopt a resolution authorizing the City Manager to execute the Second Amendment to the Park Agreement for the FMC Willow and Grand Park Project at 8787 Enterprise Drive (APNs 537-0852-001-08, 537-0852-002-009, & 092-0100-005).

3. Resolution to Amend the Affordable Housing Obligation Satisfaction Agreement for the Willow and Harbor Pointe Projects to Extend the Completion Deadline and Change the Affordability Unit Mix.
